Welcome to My Creative Designs (https://mycreativedesigns.in/). These Terms and Conditions (“Terms”) govern your use of our website and services. By accessing or using our website or hiring us for any service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using our services.

Services We Provide

We offer the following services:

Custom WordPress Website Design and Development
Google Ads Campaign Management
Facebook Ads Campaign Management

Payment Terms

Web Design Services:

50% advance payment is required to initiate the project.
The remaining 50% must be paid after final approval but before the website is delivered or made live.
Refunds are available only on the advance payment if the design is not approved by the client.
Once the final project is delivered or hosted, no refund will be issued.
Please note that, if the website is designed as per the client’s choice, preference, or approved references, no refund will be issued under any circumstance.

Digital Marketing Services (Google Ads / Facebook Ads):

100% payment towards service charges must be made upfront before any work begins.
Ad spend is not included in our service charges and must be borne separately by the client.
Clients are responsible for funding their ad accounts directly (e.g., Facebook Ad Manager, Google Ads).
No refunds are available once the payment is made, as marketing services are time-sensitive and budget-driven.

Project Timelines

Estimated timelines for delivery are discussed individually based on project scope. Delays due to client-side inactivity (e.g., not sharing content or feedback) are not the responsibility of My Creative Designs.

Client Responsibilities

Provide all necessary content (text, images, branding) in a timely manner.
Cooperate during the feedback and revision process.
Make payments on time as per the agreed terms.
Ensure sufficient ad budget is available in your advertising accounts if using our marketing services.
Any domain, hosting service, and ad accounts are in the client’s scope. I will provide guidance and support in purchasing or creation of the same.

Intellectual Property

All work (including designs, text, and graphics) created by My Creative Designs remains the property of My Creative Designs until full payment is received. Upon full payment, ownership of the final design is transferred to the client.

We reserve the right to showcase completed projects in our portfolio unless otherwise agreed in writing.

Restrictions and Acceptable Use

You agree not to:

Use our website or services for any unlawful, harmful, or fraudulent activities.
Copy, reproduce, or exploit our website content or services for commercial purposes without written consent.
Misrepresent our services or claim ownership of our work without payment.

Cancellation Policy

For web design services, cancellation is allowed before the final delivery. A refund of the advance will be issued only if the client does not approve the design.
For marketing services, cancellations are not permitted once the campaign work has begun or ad spend is allocated. The service fee is non-refundable.

Limitation of Liability

We are not liable for any direct, indirect, or incidental damages resulting from the use or inability to use our website or services. While we aim for the highest quality, we do not guarantee specific outcomes in marketing or design performance.

Modifications to Terms

We reserve the right to update or change these Terms at any time. Continued use of our services constitutes acceptance of any changes made.
